It's not easy being a tiefling

It really depends on if you get caught by the guards, or by the player. All of the people that are into roleplay will try and turn it into a nice scenario where perhaps something can be gotten out of it by both parties.
If they aren't that into RP, you'll be expecting a quick death most likely.

Hope you were not refering to my posts there. Was just trying to clear up if spot was actually a defense against pick pockets which it looks like it's not and there is nothing that actually hampers the pickpocket attempt it's just a dc 20 check. Has anyone tested if turning someone to hostile gives them a negative on the dc check. If I recall correctly there was a penalty to pickpocketing a hostile target in NWN 1.

As far as how does a master pickpocket become a master pickpocket without a criminal record; it is possible to pickpocket NPC's, including ones that are by themselves so if caught it turns into a murder if the thief managed to kill them, and goblins and other hostile creatures. Is just much harder.
I don't know if this is currently possible here but it use to work on other mods that I have played on.

I don't get caught. I get
accused.
Just because you have horns and are good with traps doesn't mean you go around checking everybody's pockets, all right?
See what I mean? It's like accusing all drow of being murderous basta... Um Never mind that one.

Spot skill?
In order to 'spot' a guy with Nimble Fingers, SF: Slight of Hand, 20 dex, and lets say level 4 you'd need (At level 1) more feats than you can get. It dosen't get any easier versus a good pickpocket build either as their SoH skill just keeps rocketing up while your spot skill only goes up in small fits.
That's assumeing you spend every feat you get uping your spot skill, and have maxed whatever stat's required. It only goes downhill from there...Assumeing you actually, ya'know, want to play the game.

I also follow a kinda guidelines to how and what are acceptable.
I know, it doesnt help you guys, but here is a general overview
of How I run Dario, My Ingame thief....
1) I only steal from each person, MAX every 30 minutes.
2) I actually Maneuver, move and try and sneak up
near terrain, and trees, or around corners,
3) I actually check and make sure the person is
MODERATE or greater before I steal from them,
otherwise, I feel like Im kicking a puppy
4) RUN LIKE HELL, Makes no sense that you would
kinda sit there, counting the coins, after a lift. LEAVE.
Gives the mark a chance to see you moving, and figure it out.
Is it just me or does this sound about as 'roleplayed' as YARRRRRR I AM BIKKIE THE NEWIBE KILLER! IM CE! PREPEARE TO DIE EVERYONE!

Aren't all the guards DMs?

Speak for yourself.
I'm into RP, but if I catch you stealing I'll nuke first and ask questions later. And yes, I've played a pickpocket. It's a risk you take when you click the steal button.

Except the way it was phrased makes it sound like he only steals from people who rate as moderate, challenging, overpowering, or impossible. I can respect that.
I'll still nuke first, though.

I think this misconception steers from the visable usergroup.

Actually, none of the player guards are DMs. Furthermore the DMs are no more protected from being pick pocketed than the rest of us, as evidence by the fact that Wyv got hit himself, in front of me... as I am sure some of the other DMs when playing.
I wish to add that some of these griefing pick pocketers may wish to be more careful, you never know when that level 1 or 2 newb you are harassing is a staff member in disguise.

I've made a suggestion, half jokingly, that it gets set so if a thief is killed by a player within a certain time after stealing an item he drops his entire inventory...

I have seen a fair few pick pockets lately and all of them halfling rogues. So now when ever I see a halfling I am tempted to just kill them saves me trouble. I also hate anyone bumping into me be they a rogue or not. Barging into people is just gets plain annoying even if they are not trying to steal form you.
There really is very little you can do to stop someone PPing you. I do think that there shouldbe a weight limit if possible. A few potions, jewelery or some gold is resonable but taking a suit of platemail from someone is not pick pocketing thats stripping someone naked and having them not notice.
I do like Tin's suggestion though
